These Terms & Conditions (“Terms”) govern your access to and use of the koreinside.ai website and the AI-powered computer vision and analytics services operated by Kore (“Kore”, “we”, “us”, or “our”) (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

When you create an account, you must provide accurate and complete information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use or security breach.

2. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law or regulation
• Submit content you do not have the rights or necessary consents to submit
• Reverse engineer, scrape, or attempt to extract our models or source code
• Interfere with, disrupt, or place undue load on the Service or its infrastructure
• Resell or provide the Service to third parties without our written permission
• Use the Service to build a competing product or service

3. Subscriptions, Fees & Payment

Some features of the Service are provided on a paid subscription or usage basis. Fees, billing frequency, and plan details are set out in the applicable order form, pricing page, or written agreement. Unless stated otherwise, fees are quoted exclusive of taxes, and you are responsible for any applicable taxes. Subscriptions may renew automatically unless cancelled before the renewal date.

4. Refunds

Refunds are handled in accordance with our Refund Policy, which forms part of these Terms. In short, if you experience a genuine problem with the Service and our support team is unable to resolve it, we will initiate a full refund.

5. Intellectual Property

The Service and its original content, features, models, and functionality are and remain the exclusive property of Kore and its licensors, and are protected by copyright, trademark, and other laws. Our name, logo, and trademarks may not be used without our prior written consent.

6. Your Content & Data

You retain ownership of the footage and data you submit to the Service (“Customer Content”). You grant Kore a limited, worldwide license to host, process, and analyze Customer Content solely to provide and improve the Service. You are responsible for ensuring you have all rights and consents needed to submit Customer Content, including footage of individuals.

7. Third-Party Services

The Service may integrate with or link to third-party websites and services that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of them is at your own risk and subject to their terms.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analytics results will be perfectly accurate.

9. Limitation of Liability

To the maximum extent permitted by law, Kore will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kore and its officers, employees, and partners from any claims, damages, or expenses arising out of your use of the Service, your Customer Content, or your breach of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we reasonably believe your use poses a risk to Kore or others. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. You agree that the state and federal courts located in San Francisco County, California will have exclusive jurisdiction over any dispute arising out of these Terms or the Service.

13. Changes to These Terms

We may modify these Terms from time to time. When changes are material, we will update the “Last updated” date above and, where appropriate, provide additional notice. By continuing to use the Service after changes take effect, you agree to the revised Terms.
